Introduction
This virtual classroom seminar will aim to deal with the potential legal pitfalls and discuss ways to ensure the best possible prospects of succeeding with a claim for malicious prosecution.
You will look at how to identify who is the prosecutor, how to prove damage and the use of other complimentary torts.
One of the most interesting recent cases in this area is Rees and others v Metropolitan Police, arising out of the still unsolved murder of Daniel Morgan.
The case has had a chequered procedural history, but the Court of Appeal have given a very useful judgment which will form the basis of our learning.
