Introduction
After several false starts and a global pandemic, the Liberty Protection Safeguards are likely to replace the Deprivation of Liberty Safeguards at some point in early 2024. ‘Responsible Bodies’ up and down the country have appointed their LPS leads and, guided by ‘LPS Champions’ appointed by the DHSC, the push is now on to turn the dream of a streamlined, easily understood, way of depriving people who lack the capacity to consent to care and/or treatment into a reality.
With this major change to the legislation will come major changes to the way mental capacity law and mental health law practitioners work and in the nature of the advice they give to their clients.
This webinar will look at the differences between LPS and DoLS.
What You Will Learn
This webinar will cover the following:
- The roles of the various Responsible Bodies in authorising deprivations of liberty
- The importance of those authorisations taking place within a strict timeframe and, in all but genuine emergencies, before any deprivation has actually occurred
- The difference between assessing capacity to consent to accommodation for the purposes of care and/or treatment and the capacity to consent to ‘arrangements’ for care and/or treatment
- The approach likely to be taken by the new Code of Practice in determining what is, and what is not, a deprivation of liberty
- The effect of enlarging the ‘catchment’ area of LPS to include 16- and 17-year-olds and people who reside in places other than care homes and hospitals
