Course Outline
Introduction
This virtual classroom seminar will provide delegates with an update on the substantive rights homeless people have in Scotland - focusing on the local authority’s duties to take homeless applications and secure interim and permanent accommodation. These are areas of law which have recently been changed by legislation or clarified through being tested in court.
The cases of Dafaalla v City of Edinburgh Council [2022] CSIH 30 and X v Glasgow City Council [2022] CSOH 35 will be discussed.
As well as learning about those changes, participants will be given practical advice on how to improve decision making in the context of local authority statutory duties.
What You Will Learn
This live and interactive session will cover the following:
- Overview of when the statutory duties to take an application and secure interim accommodation arise
- Changes made to the standards of interim accommodation through Unsuitable Accommodation (Scotland) Order 2014, as amended
- Implications of recent Scottish cases concerning local authority statutory duties to take homeless applications and provide interim accommodation
- Examination of the statutory duty to secure permanent accommodation and how this might be performed
