Introduction

This virtual classroom seminar will deal with advanced aspects of sentencing Youth Court, Adult Magistrates’ Court and Crown Court.

Sentencing is an ever-evolving area and there is always something new to learn, the session will deal with the trickier aspects of the Sentencing Act 2020 and the Police, Crime, Sentencing and Courts Act 2022.

What You Will Learn

This live broadcast will cover the following:

  • The position on sentencing at the Crown Court under the Sentencing Act 2020 where the defendant has been both committed for sentence from the Magistrates’ Court and sent for trial from the Magistrates’ Court in relation to connected either-way offences
  • The position of the Crown Court Judge in terms of today’s sentence where he/she knows that the defendant has been recalled for a breach of their parole licence - the legislation in this area and the case-law
  • Certain offenders at the Crown Court given a sentence of 4 years or more - their new terms of release under the Police, Crime, Sentencing and Courts Act 2022
  • The sentencing of ‘offenders of particular concern’
  • Custody and a disqualification from driving - extensions and adjustments of the term
  • Detention under Section 250 of the Sentencing Act 2020
  • Remands in custody and qualifying curfews - all change with the Police, Crime, Sentencing and Courts Act 2022
  • Extension of the sentencing powers of Magistrates under the Judicial Review and Courts Act 2022 - committals for sentence - appeals against the severity of the sentence imposed
  • The sentencing of offenders under the dangerous offender provisions
  • Sentence in the Youth Court on serious offences (formerly referred to as grave crimes)
  • The legal position regarding the making of today’s sentence consecutive to a sentence already being served
  • Re-sentencing on a breach - the legislation and the case-law in this area
