IP & Construction Contracts - What You Need to Know

Introduction

Intellectual property (IP) in construction contracts is a key contract term.

It is one which everyone should pay attention to early, at procurement, negotiation, and contract review stage. It is, however, often overlooked. Later, when future projects are being considered, or disputes arise under the extant contract, IP is an area to consult.

There are many facets to managing IP risk in construction contracts. IP is a valuable asset to many: designers, architects, engineers, contractors with design responsibility and clients. Future stakeholders too may want to be able to have a piece of the IP, or access to it.

This virtual classroom seminar will explore in detail the patchwork of IP in construction contracts. We will explore the different types of IP to look out for and which parties will be interested in which, and from what perspective. We will build a network of contracts to illustrate competing interests, and look at practical challenges, including terms of contract, potential clashes, and future users. In a consideration of the latest caselaw, we will make an action plan and then finish with a summary of takeaways.

The live session is designed for all individuals involved in construction contracts at all tiers and whether in the private or public sector. It will cover both the contract set-up and dispute resolution perspectives.
