Introduction
The GDPR in the EU and the UK places strict obligations on both controllers and processors and is extra-territorial in reach.
The ICO and the EDPB and others have published guidance on the roles and responsibilities of controllers, joint controllers and processors. In 2020 the transfers of personal data from the European Economic Area (EEA) to other jurisdictions were affected by a combination of the CJEU decision known as Schrems II, the declaration on the invalidity of the EU-US Privacy Shield, the guidance from the European Data Protection Board, the publication of the new EU SCC, the Adequacy Decision for the UK post Brexit and more recently the UK proposal for an Addendum to the new EU SCC.
