Trying to work out whether a retail price promotion complies with the UK’s principle-based consumer protection legislation can be a very difficult task in practice for those unfamiliar with established pricing rules.
This is particularly the case given the wide array of different types of price promotion that are often used, ranging from straightforward ‘was’/‘now’ price discounts to Black Friday style sales that apply to the entire store or website, such as ‘up to 50% off everything!’
In addition, the fast-paced nature of e-commerce - where more complex forms of dynamic pricing are becoming increasingly common - can make it difficult to determine whether a reference price used for the purpose of a price promotion is fair and genuine.
