Introduction
In the last few years case law has played a huge part in determining what should be included in the Holiday Pay calculation. The most recent case, Harpur Trust v Brazel, confirmed holiday leave rights for casual workers / zero-hour contracts.
So where does this leave employers? What exactly is a worker entitled to, and how should their holiday pay be calculated? We look to the government following the fiscal event on 23rd September 2022, when the new chancellor, Kwasi Kwarteng, confirmed the Retained EU Law (Revocation and Reform) Bill, which aims to end EU legislation by December 2023. Will this simplify the holiday calculation? What should we do in the meantime?
